Ethical Case Study
Mrs. Peterson is an 82-year-old woman living in an Alzheimer’s unit of a long-term care facility. She was diagnosed with dementia a few years ago and had moved to the Alzheimer’s unit 6 months ago after Mr. Peterson, her husband of 58 years, could not care for her at home. Mr. Peterson visited the nursing home every day and Mrs. Peterson was always happy to see him. One day during an afternoon med pass, Julie, the nurse, walked into Mrs. Peterson’s room and found her and Mr. Peterson in bed together with some of their clothes off. Julie waited until after Mr. Peterson left and then returned to Mrs. Peterson’s room to talk further with her about what had happened. Mrs. Peterson commented how she loved her husband but couldn’t answer any further questions regarding whether she felt comfortable engaging in sexual activity with him. Julie set up a meeting with the director of nursing and shared her concerns about how Mrs. Peterson’s dementia might affect her decision-making capacity to consent to sexual activity and wondered if it was appropriate for Mr. Peterson to engage in it with his wife. The director of nursing wondered what the right thing was to do.
