One of its goals is to enforce regulations where any part of a government agency is a party. State medical boards are government entities that, among other roles, take action against physicians for behaviors that violate the law or otherwise jeopardize patient safety. One state medical board’s monthly agenda included taking actions against physicians who Abused alcohol and other substances that impaired their ability to practice Delegated medical device usage to an unlicensed individual Improperly prescribed medications Obtained health records of a former patient without authorization and by using an altered release Engaged in sexual misconduct with a patient Made misleading statements to procure a license to practice and committed felonies either related or unrelated to their practice of medicine Identify if physician disciplinary action should be within the realm of public law, or whether it should it be a private law matter between the physician and a wronged party? Organize the above list as to whether the wrongdoing is subject to public law or private law If so, which of the previous list of offenses would you place in each category? In all cases, the physicians are entitled to due process. Articulate the types of due process they are entitled to. Give examples of each. Identify whether felonies committed outside the individual’s practice of medicine should be subject to state government disciplinary action in all cases? No cases? Or Some cases?
