Marina is a famous TikTok influencer who is visiting a nice village in England as part of her holiday. She is staying in a small luxury hotel in the Lake District. Her room overlooks the lakes and mountains in this area.
Marina felt so inspired by the view that she decided to film a reel promoting some products for the company she was in partnership with. In order to set the scene for the reel, Marina wanted a pretty plant in the background. She then remembered that the hotel owner was a passionate gardener who was selling various flowers and plants next to the reception in the hotel lobby. She contacted the reception and asked if they had a pretty plant which she could rent to include in her reel. The hotel offered her a Strelitzia Nicolai Variegata (a beautifully colourful and rare plant) which was to be returned by 6pm the same day as it needed to be kept in a cool room during the night. The hotel mentioned that it was a very expensive plant but due to Marina being a famous TikToker, the owner was happy to allow her to borrow it for £150 subject to Terms and Conditions in an agreement.
After finishing filming the reel, Marina went out for dinner and drinks, and she completely forgot to return the plant.
She came back to the hotel late and went straight to bed. In the morning, several issues arose:
a. The tap in the bathroom started leaking all over the bathroom floor, in the middle of the night, and when Marina went to take a morning shower, she slipped on the floor and hurt her knee.
b. She left her expensive Jimmy Choo silk shoes worth £1200 in the bathroom overnight which are now ruined by the leaked water.
c. When the hotel employee came in the morning to collect the plant, Marina was told she owed £7150 for the hire of the plant.
Marina contacted the hotel manager, and she was told the following:
a. The administration of the hotel had excluded any liability for an injury by providing a sign in each hotel room next to the phone on a bedside table. Marina was not aware of the sign.
b. The administration of the hotel limited their liability for any damage to the guests’ property to £100. This was stipulated on the back of the receipt after Marina paid for her stay and also at the hotel reception desk.
c. When the plant was delivered to Marina, it arrived along with the contract which she had to sign. At the end of the document, there was a clause stipulating that if the plant was not returned by 6pm on the same day, her final bill would be £7150 (£150 to rent a plant and £7000 late penalty fee).
Discuss the following scenario by advising Marina whether the hotel can avoid liability for Marina’s injury, ruined shoes; and whether Marina needs to pay the £7150 late penalty fine?

DESCRIPTION OF THE TASK:
Students should discuss and analyse the problem question with reference to case law and any relevant statutory provisions. This means that students should:
- Identify the relevant issues raised in the scenario (i.e. What are they?).
- Discuss them by supporting your answer with relevant case law and statutory provisions (i.e. How does the law deal with similar issues?).
- By doing this, you are discussing the situation Marina is in by focusing on the actions of the Hotel (i.e. Apply your legal discussion to the scenario directly).
You will learn how to answer such questions in seminars where we will deal with scenario-based problem questions. In addition, we will also learn how to structure such answers in Seminar 6.
There is no minimum number of cases a student should use; however, due to the word limit, students should only use those cases which are directly relevant, and which add value to the general argument.
Students should use the ILAC (Issue/Law/Application/Conclusion) system to answer the above problem question.
Submission requirements:
- The assignment should be submitted in Times New Roman 12 with 1.5 spacing.
- The assignment should be submitted in Microsoft Word Document.
- The assignment should be submitted via Turnitin on Blackboard. Any assignments which are emailed to the team will NOT be accepted.
- Ensure you attach a Bibliography which clearly lists all the sources and cases used throughout the assignment, including those which you read but did not reference in your answer.
- Ensure you are familiar with Academic Misconduct Regulations.
NB: Your assessment MUST include footnotes and OSCOLA needs to be used when citing sources. This is the minimum requirement to achieve a pass.
Don’t (the below might incur penalties):
✓ Use improper/incorrect/poor references—OSCOLA should be used.
✓ Use unofficial sources, i.e. Wikipedia, LawTeacher.net and other similar sources (please note that Turnitin will always pick up these sources).
✓ Make grammar mistakes and ensure an assignment is proof- read before the submission.
✓ Plagiarise—students will be reported for plagiarism
✓ Submit AFTER deadline as all late submissions (unless you have a PMC/RAP) will be penalised.
Do:
✓ Proper and careful research of case law and, if applicable, journal articles—students can use the textbook as an initial source for case law and other reliable legal sources.
✓ Follow a structure to produce a concise and good answer.
✓ Read and analyse case law of your choice and decide how you are going to discuss them in your essay.
✓ Give yourself plenty of time to write your essay to produce a good work.
Summary:
✓ It is a student’s choice WHICH cases to choose but the main case law and legislation should be used and discussed.
✓ All answers should be properly referenced (OSCOLA) to avoid plagiarism.
✓ Students ARE NOT allowed to use Wikipedia and LawTeacher.net and WILL BE penalised if these (or any other similar sources) are either used/referenced/relied on.
✓ Please note that teaching staff will NOT read any drafts.

How to Submit
Your assessment should be 2000 words.
There is a 10% leeway permitted if needed, thus you may exceed the word count within said 10% which amounts to NO MORE than 2200 total words. If the words exceed 2200, then markers will cease considering content for the purpose of grading and feedback once the stated
maximum length has been exceeded and award marks ONLY on the basis of work within the stated acceptable upper limit of length.
You MUST include a word count with your work.
NB: The bibliography is NOT included within the word count. However, footnotes ARE INCLUDED within the word count.

You should submit your assessment via Blackboard Assessment on Blackboard.
As the University will mark assessments anonymously where possible, include your student roll number and not your name on your assessment. Do not upload links in the submission area, as we cannot access them and therefore cannot mark your work. If you have saved your files on your University of Salford OneDrive, dragging files to the submission area may attach a link instead of the file. Always attach files using the paperclip icon.
For coursework assessments only: students with a Reasonable Adjustment Plan (RAP) or Carer Support Plan should check your plan to see if an extension to this submission date has been agreed.

Assessed intended learning outcomes
30-39—Needs Improvement
Demonstrates some knowledge of subject area but with major inaccuracies/misconceptions. Even though some of the relevant issues had been correctly identified, the discussion of the main principles was unsatisfactory. In particular, the discussion was very basic, descriptive with no independent analysis or very little law.
There were major gaps in the knowledge which indicated a severe lack of understanding the topic. The assignment also contained very limited/no sources or no OSCOLA at all.
NB: Students who did not use OSCOLA and did not include a single footnote, will not pass.
40-49—Adequate
Demonstrated adequate knowledge of the subject area but limited in breadth and/or depth. The relevant issues and principles had been correctly identified and some discussion had been provided. However, the discussion was mainly basic, descriptive, and representative with very limited independent analysis. OSCOLA was poor and more analysis was required.
50-59—Fair
Demonstrated fair knowledge of subject area. Few limitations in depth and/or breadth. Discussions surrounding the question posed demonstrated a fair understanding of the subject. The issues and
principles had been correctly identified, and a fair and reasonable discussion had been provided. However, the discussion was, at times, descriptive with only some independent analysis. OSCOLA was fair.
60-69—Good
Demonstrated good knowledge of subject area in depth and breadth. Discussions surrounding the question posed demonstrated a good understanding of the subject. The issues and principles had been correctly identified, and a good discussion had been provided. On occasions, the discussion was descriptive and illustrative which
could be remedied by providing a more thorough analysis and research. However, the descriptiveness of the answer did not significantly affect the quality of the assignment. OSCOLA and use of sources were good.
70-79—Very Good
Demonstrated a very good knowledge of subject area in depth and breadth. Discussions surrounding the question posed demonstrated a very good understanding of the subject. The issues and principles had been correctly identified, and a very good discussion had been
provided. The discussion was relevant, accurate, interesting and intellectual with a very good intellectual analysis. Very good use of OSCOLA and sources.
80+ Excellent
Demonstrated excellent knowledge of subject area in depth and breadth. Discussions surrounding the question posed demonstrated an excellent understanding of the subject. The issues and principles had been correctly identified, and an excellent discussion had been provided. Analysis was present throughout and the answer contained no mistakes. The discussion was highly intellectual and contains excellent evaluation. Excellent use of case law and limited/no OSCOLA mistakes. On successful completion of this assessment, you will be able to:
- Identify and evaluate contractual principles through case-law and statutory interpretation.
- Apply appropriate contractual principles to a range of problem scenarios and provide articulate and logical solutions.
