1. Acceptance of Terms

By accessing and using openbooks.link ("the Platform", "we", "us", or "our"), you confirm that you have read, understood, and agree to be bound by these Terms of Use ("Terms"). These Terms govern your access to and use of our website, services, and all associated content. If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately.

StudyMerit reserves the right to modify these Terms at any time. Updated Terms will be posted on this page with a revised effective date. Your continued use of the Platform after any changes constitutes acceptance of the new Terms.

2. Description of Service

StudyMerit is an independent online marketplace that connects students and individuals ("Clients") with independent professional writers ("Writers") who provide academic writing, editing, proofreading, and related services. StudyMerit acts solely as an intermediary platform and does not directly author, review, or guarantee the content of any completed work.

All work produced through StudyMerit is intended exclusively as a model, reference, or study aid. Clients are solely responsible for how they use any completed work in accordance with the rules and academic integrity policies of their educational institution.

3. Eligibility

You must be at least 18 years of age to use StudyMerit. By registering an account, you represent and warrant that:

• You are 18 years of age or older
• You have the legal capacity to enter into binding agreements
• All registration information you provide is accurate, current, and complete
• You will maintain the accuracy of such information throughout your use of the Platform

4. Account Registration & Security

To place an order, you must create an account on StudyMerit. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:

• Provide truthful and accurate registration information
• Immediately notify StudyMerit of any unauthorised use of your account
• Not share your account credentials with any third party
• Not create multiple accounts for abusive or fraudulent purposes

StudyMerit reserves the right to suspend or terminate accounts that are found to be in violation of these Terms or used in a manner deemed harmful to the Platform, its users, or third parties.

5. Ordering & Payment

When placing an order on StudyMerit, you submit your assignment requirements and set a budget. Verified Writers on the Platform review your order and submit competitive bids. You may review Writer profiles, ratings, and sample work before selecting a Writer. Payment is only processed once you have confirmed a Writer selection.

• All payments are processed securely through our SSL-encrypted payment gateway
• We accept Visa, Mastercard, American Express, and Discover
• Funds are held in escrow and released to the Writer only upon your approval of the completed work
• Prices are displayed in USD. International transaction fees may apply depending on your card issuer
• StudyMerit does not store payment card details on its servers

6. Revision Policy

If the delivered work does not meet the requirements specified in your original order, you are entitled to request free revisions from your assigned Writer. Revisions must be requested within the revision window applicable to your order type. Revision requests must not introduce new requirements not originally stated in the order.

7. Intellectual Property

Upon full payment and release of funds to the Writer, ownership of the completed work is transferred to the Client. StudyMerit and its Writers retain no claim over the delivered content. However, StudyMerit reserves the right to use anonymised or aggregated data relating to orders for service improvement and quality assurance purposes.

All trademarks, logos, service marks, and brand identifiers displayed on StudyMerit are the property of StudyMerit or their respective owners. You may not use any StudyMerit branding without prior written consent.

8. Prohibited Conduct

You agree not to use StudyMerit for any unlawful, fraudulent, or harmful purpose. Prohibited activities include but are not limited to:

• Attempting to gain unauthorised access to any part of the Platform
• Uploading or distributing malware, viruses, or harmful code
• Harassing, threatening, or abusing Writers, support staff, or other users
• Posting false, misleading, or defamatory content
• Circumventing the Platform to transact directly with Writers outside StudyMerit
• Misrepresenting your identity or institutional affiliation
• Using the Platform for any activity that violates applicable laws or regulations

9. Disclaimer of Warranties

StudyMerit provides the Platform on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from viruses or harmful components. While we take steps to ensure Writer quality, StudyMerit does not guarantee specific academic outcomes or grades.

10. Limitation of Liability

To the maximum extent permitted by applicable law, StudyMerit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform or any services obtained through it. Our total liability to you for any claims arising under these Terms shall not exceed the total amount paid by you to StudyMerit in the three months preceding the claim.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with applicable law. Any disputes arising in connection with these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be subject to binding arbitration.
