Write an essay, styled after a case brief for the selected accused/charge. You will take a position and justify/support that stance such as:
Stephen Fry should be convicted of impaired because…
Stephen fry should not be convicted of Impaired due to a violation of…
Justification will consist of supporting arguments from:
The Criminal Code, facts in issue, authorities, defences, etc.
The Charter, sections, tests, and remedies
Case law, previous rulings from Provincial Appeals Court’s or SCC
Common Law
Format:
Minimum 2 additional supporting references, over and above Criminal Code sections and Charter sections.
I expect you to locate and cite at least two cases (R v. Someone) that support your argument. Any other supporting references can be from a textbook, news reports, legal web sites or blogs. Use proper in text citations and reference pg.
